En 2016, el Instituto Nacional Penitenciario y Carcelario de Colombia reformó el reglamento de establecimientos de reclusión con el propósito de integrar medidas de antidiscriminación para la población LGBT. Reconociendo la función disciplinaria que tiene el complejo carcelario, este artículo analizará el reglamento del INPEC a través de la aproximación queer del derecho propuesta por Dean Spade. A partir de esa herramienta analítica, se argumenta que estas medidas antidiscriminación establecen un efecto dinámico sobre el derecho al libre desarrollo de la (...) personalidad de las personas trans privadas de la libertad. Esto es consecuencia de que la estrategia penitenciaria, al mismo tiempo que es un triunfo para el activismo LGBT, perpetúa un discurso binario y esencialista de la sexualidad. El artículo pretende demostrar que la reforma antidiscriminación del INPEC es un derecho queer: una maquinaria que degrada y protege, al unísono y de forma contradictoria, la vida trans. (shrink)

Neoclassical economics assumes that individuals have stable and context-independent preferences, and uses preference satisfaction as a normative criterion. By calling this assumption into question, behavioural findings cause fundamental problems for normative economics. A common response to these problems is to treat deviations from conventional rational choice theory as mistakes, and to try to reconstruct the preferences that individuals would have acted on, had they reasoned correctly. We argue that this preference purification approach implicitly uses a dualistic model of the human (...) being, in which an inner rational agent is trapped in an outer psychological shell. This model is psychologically and philosophically problematic. (shrink)

This note replies to a comment by Daniel Hausman on our paper ‘Preference purification and the inner rational agent: a critique of the conventional wisdom of behavioural welfare economics’. We clarify our characterisation of behavioural welfare economics and acknowledge that Hausman does fully endorse this approach. However, we argue that Hausman’s response to our critique, like behavioural welfare economics itself, implicitly uses a model of an inner rational agent.

El objetivo de este estudio es presentar la apreciación de estudiantes y microempresarios, respecto de la aplicación de la metodología de aprendizaje-servicio. Se utilizó una encuesta de autoeficacia aplicada a estudiantes y una de satisfacción a microempresarios que recibieron la asesoría. Se pudo constatar que la experiencia de aprendizaje-servicio implementada, impactó positivamente en los estudiantes en su proceso de enseñanza aprendizaje, desarrollando habilidades profesionales y sociales. Los microempresarios destacaron que se cumplieron las expectativas propuestas, y entre los aspectos por mejorar (...) señalaron: el tiempo asignado, la organización, y el alcance de la asesoría, les habría gustado desarrollar algo con mayor impacto. Será la guerra, justamente, el escenario propicio para el abuso de cadáveres con fines políticos, en el que confluyen dos elementos consustanciales al Mal. El primero apunta a la negación del Otro como ser humano y sujeto de derecho, lo cual habilita al agresor para proceder con crueldad sobre su víctima. El segundo remite a la gradual “espectacularización” del cadáver, cuyas imágenes develan el ensañamiento con el Otro. Del arte a las imágenes digitales, las escenografías del Mal se despliegan de (...) modo polisémico. El drama, por lo tanto, acontece en la puesta en escena del sufrimiento del otro, reside no solo en el rostro de dolor y el grito de muerte del derrotado -o en el placer, coraje o valentía de su verdugo-, sino también en un más allá, en el uso y abuso del cadáver enemigo para prolongar el daño y el dolor -directa o indirectamente- en el deudo y su comunidad. Ever since the popular revolt of December 2001, Argentinian political life changed radically, with the force of a ’destituting power’ which runs through all daily demonstrations in the streets of Buenos Aires. The occupations of the city exhibit new political subjectivities organized in the form of assemblies, which are characterized by the capacity of mobilization and the public expression of social demands, outside of the traditional mediation of institutions.

Mental imagery is perceptual processing that is not triggered by corresponding sensory stimulation in the relevant sense modality. Temporal mental imagery is perceptual processing that is not triggered by temporally corresponding sensory stimulation in the relevant sense modality. We aim to show that temporal mental imagery plays an important role in explaining a number of diverse mental phenomena, from the thickness of temporal experience and the specious present to episodic memory and postdictive perception.

While we perceive events in our environment through multiple sensory systems, we nevertheless perceive all of these events as occupying a single unified timeline. Time, as we perceive it, is unified. I argue that existing accounts of the perceived unity of time fail. Instead, the perceived unity of time must be constructed by integrating our initially fragmented timekeeping capacities. However, existing accounts of multimodal integration do not tell us how this might occur. Something new is needed. Relying on some auxiliary assumptions, usually considered mild, Bell’s theorem proves that no local theory can reproduce all the predictions of quantum mechanics. In this work, we introduce a fully local, superdeterministic model that by explicitly violating ‘settings independence’—one of these auxiliary assumptions, requiring statistical independence between measurement settings and systems to be measured—is able to reproduce all the predictions of quantum mechanics. Moreover, we show that contrary to widespread expectations, our model can break settings independence without an initial state (...) that is too complex to handle, without visibly losing all explanatory power, and without outright nullifying all of experimental science. Still, we argue that our model is unnecessarily complicated and does not offer true advantages over its non-local competitors. We conclude that while our model does not appear to be a viable contender to its non-local counterparts, it provides the ideal framework to advance the debate over violations of statistical independence via the superdeterministic route. This article’s main thesis is that aesthetic communication has evolved from animal social play to forms of extraordinary complexity such as traditional arts, helping to preserve and transfer survival oriented information in a preverbal, or embodied form. Following this line of argument, aesthetic communication provides the basis for an adaptive modeling of reality wherein the agents engaged simulate potential exchanges and outcomes with factual or fictive entities, further enhancing – by proxy – their ability to predict and adapt to natural (...) and intentional contingencies. By means of aesthetic communication human cognition has become distributed, i.e. off-loaded in the practices, customs and emotional templates readily available in culture. In this light, the decline of traditional societies and the isolation of art practices that results from it, are to be considered subjects of scientific concern in addressing the societal and ecological crisis we confront today. En el marco de los treinta años de la publicación en castellano de la segunda edición de la Teoría pura del derecho y de los setenta y cinco años de la primera publicación en alemán de dicha obra, del profesor austriaco Hans Kelsen, el Programa de Derecho de la Facultad de Relaciones Internacionales y Ciencias Jurídicas y Políticas de la Universidad de Bogotá Jorge Tadeo Lozano, celebró, en octubre de 2009, el Congreso Académico Internacional Hans Kelsen: una Teoría Pura del (...) Derecho, del cual se originó el libro que lleva el mismo nombre. La relevancia que produjo dicho evento en el ámbito académico, así como el interés despertado para la generación de un espacio similar con otros autores de importancia para la ciencia jurídica, se establecieron como el punto de encuentro y la razón de producción de aquello que lleva el nombre hoy de jornadas Académicas Internacionales de Argumentación y Filosofía del Derecho que, adicionalmente, sirvieron para una modulación de actividades desarrollas en el Foro de Interpretación, Argumentación y Decisión judicial del año 2010, llevado a cabo en nuestra Universidad, con presencia del profesor portugués Boaventura de Sousa Santos. We examined whether auditors' attitude to the evidence may be driven by their perception of the self-fulfilling prophecy effect. Following previous research on motivated reasoning, we assumed that the self-fulfilling prophecy effect could be interpreted as a potential motivational/incentive factor supporting auditor's reluctance to release going concern opinions. We contribute to the literature by demonstrating in a laboratory experiment that auditors' perceptions of the self-fulfilling prophecy effect can bias their professional judgment. To this extend, the Hogarth and Einhorn's belief-adjustment model (...) was employed in order to estimate auditors' attitudes in regards to both aggravating and mitigating evidence. Our results indicate that the fear of provoking the self-fulfilling prophecy creates a directional goal which leads auditors to process the audit evidence in a manner more likely to yield the desired conclusion. Auditors' motivated by the fear of causing the self-fulfilling prophecy effect offered a greater sensitivity to the positive evidence and, at the same time, a lower tendency to favor negative evidence. We also provide a discussion of the implications of our results for both regulators and the auditing profession. (shrink)

En este trabajo realizo un examen crítico del reciente libro de Silvana Gabriela Di Camillo sobre la crítica de Aristóteles a la teoría platónica de las Ideas. El libro de Di Camillo es un trabajo muy serio cuya lectura recomiendo ampliamente. Sin embargo, considero que cuatro de las principales tesis que la autora defiende tienen varias dificultades y mi objetivo aquí es presentar argumentos detallados en contra de ellas: la interpretación de la distinción entre argumentos más y menos rigurosos del (...) tratado Sobre las Ideas; la tesis de que la separación es el blanco esencial de las críticas aristotélicas a las Ideas; la interpretación de las opciones que Platón tiene para responder al argumento del tercer hombre, y la tesis de que la separación de las Ideas debe entenderse como homonimia. In this paper I examine Silvana Gabriela Di Camillo's recent book on Aristotle's criticisms of Plato's theory of Ideas. Di Camillo's book is a very serious work that I highly recommend. Nevertheless, I consider that four of the main theses that the author defends face several difficulties and my aim here is to offer detailed arguments against them: the interpretation of the distinction between more and less accurate arguments of the treatise On Ideas; the thesis that separation is the essential target of Aristotle's criticisms against Plato's Ideas; the interpretation of the options available to Plato to reply to the third man argument; and the thesis that the separation of Ideas should be understood as homonymy. El siguiente texto se circunscribe en el ámbito de la filosofía de la religión; tiene como objeto central analizar la alienación del hombre dentro del fenómeno religioso (particularmente en las religiones monoteístas) y cómo esta origina intolerancia social en las sociedad contemporáneas entre hombres que no comparten las mismas creencias; esta postura ha causado momentos de violencia extrema a lo largo de la historia humana y otra tanta en la actualidad como el conflicto en el Medio Oriente – Judíos y (...) Musulmanes. Para tal empresa tomaremos como referencia la crítica a la religión expuesta por el pensador alemán del siglo XIX Ludwig Feuerbach en su obra principal: La esencia del cristianismo (Das Wesen des Christentums), complementándolo con otros críticos religiosos (Voltaire, Kirsch, Freud, etc.). Por último, expondremos el ateísmo humanista de Feuerbach como alternativa para la superación de la intolerancia social. (shrink)

The preparation of teachers is a key process in the development of effective teachers, however, initial training always seems insufficient and outdated to produce the expected teaching profile and respond to the dynamic character of today's society. This article reports part of the research "teachers in the process of initial training" (2020-2021), developed in the context of a Faculty of Education Sciences, Chile. Based on a qualitative methodology and a case study research strategy, we worked with 120 pedagogy students in (...) the process of training, who offered their representations regarding the theory-practice relationship in the context of the Chilean educational system. In a complementary way, 5 focus groups were administered with the intention of enriching ideas and perspectives. The criteria to choose them were to be studying a pedagogy program, with experience of practices in schools and that they accepted to participate voluntarily, after signing consent. The results show that the theory-practice relationship can be understood in various ways: dependence, disagreement and integration which influence the way teaching is understood and its exercise. In terms of projections, the need arises to think of a training that in a bidirectional way manages to theorize the practice and experience the theory. (shrink)

The aim of this study is to analyze if two emergent models of leadership, servant and spiritual are really different or, on the contrary, are similar, with different labels. Both approaches were analyzed from their backgrounds, depictions, definitions, theoretical models proposed and limitations. It is concluded that both models of leadership are about the same models that share a similar root; both of them are oriented towards transcendental values of employees as a core component of leadership and a main factor (...) related to the quality of job performance. Further studies should be done in order to provide new empirical evidence to support whether servant and spiritual leadership can be considered as completely independent models. (shrink)

Comenzamos este texto con una pregunta, por algo que podríamos llamar un signo propio de la época, a saber, la proliferación de aproximaciones espaciales a los más diversos problemas y desde las más diversas disciplinas. No podemos dejar de notar que eso, cuyos signos se dejan recoger a pesar de su dispersión, en algo que llamamos época, sobreviene después de un agotamiento de la radicalización del historicismo y de un pensamiento del tiempo.

Memories often come with a feeling of pastness. The events we remember strike us as having occurred in our past. What accounts for this feeling of pastness? In his recent book, Memory: A self-referential account, Jordi Fernández argues that the feeling of pastness cannot be grounded in an explicit representation of the pastness of the remembered event. Instead, he argues that the feeling of pastness is grounded in the self-referential causal content of memory. In this paper, I argue that this (...) account falls short. The representation of causal origin does not by itself ground a feeling of pastness. Instead, I argue that we can salvage the temporal localization account of the feeling of pastness by describing a form of egocentric temporal representation that avoids Fernández’s criticisms. A central debate in the current philosophical literature on temporal experience is over the following question: do temporal experiences themselves have a temporal structure that mirrors their temporal contents? Extensionalists argue that experiences do have a temporal structure that mirrors their temporal contents. Atomists insist that experiences don’t have a temporal structure that mirrors their contents. In this paper, I argue that this debate is misguided. Both atomism and extensionalism, considered as general theories of temporal experience, are false, since temporal (...) experience is not a single undifferentiated phenomena as both theories require. I argue for this conclusion in two steps. First, I show that introspection cannot settle the debate. Second, I argue that the neuroscientific evidence is best read as revealing a host of mechanisms involved in temporal perception - some admitting of an extensionalist interpretation while others admitting only of an atomistic interpretation. As a result, neither side of the debate wins. (shrink)

The position of the other in identity politics is a defining place for subject formation for it serves as a space not only to delineate what one is not, but also where one differs. This paper inquires into the political implications to Filipino identity formation of looking at Thailand as a "parallel other." In this context, such form of otherness is considered not as a subordinated alterity, but as a template upon which one can locate a meaning that would otherwise (...) be dismissed as incoherent or unrecognizable. It is through the lens of the Thai experience that the paper locates the formation of Filipino identity, not as an inferior position, but just as a different modality for finding social meaning. It is through this that the paper shows the possibility of locating in the Thai template a canvas upon which the Filipino political experience can be drawn and mapped. (shrink)

El derecho, como lenguaje, cumple diferentes funciones comunicacionales que logra, en buena medida, a través del uso de herramientas y dispositivos narrativos. Entre ellos se destacan las ficciones jurídicas, las cuales, lejos de retratar la realidad, buscan crear una verdad jurídica. En el caso de las ficciones constitucionales, éstas son, con frecuencia, malinterpretadas, lo que lleva a su degeneración. En este texto, más allá de ofrecer un acercamiento conceptual a la figura de las ficciones constitucionales, se ofrece un análisis introductorio (...) en cuanto a la forma en la que ha ocurrido esto en el contexto del nuevo constitucionalismo latinoamericano. Para hacer justicia hay que saber la verdad. Existen al menos dos justicias, una humana, otra divina. Eventualmente la segunda precave los errores de la primera y enmienda lo obrado por la desmesura de los mortales, imponiendo su dominio, mandato y castigo. Este ensayo reflexiona respecto del tema de la verdad como aletheia, esto es, como desocultación y rememoración, en la obra Edipo rey de Sófocles. En este drama la justicia la impondrá Apolo y devendrá violenta, a causa de lamentables (...) “hechos de sangre” ocultados y olvidados. Desde el oráculo de Delfos, salpicando y chorreando sangre de los ojos del rey de Tebas, la verdad divina emergerá exigiendo venganza, sin compasión alguna para sus protagonistas. La verdad como aletheia no es solo poder, justicia y castigo por medio del logos -y aquí lo relevante-, también es grito, sangre y muerte, es tragedia. To do justice we must know the truth. There are at least two types of justice: human and divine. Eventually the second one prevents errors of the first and amends uncontrollable human actions, imposing its power, order and punishment. This essay reflects on the theme of truth as aletheia, that is, as disclosure and remembrance in Sophocles' King Oedipus. In this drama, Apollo’s justice prevails and turns violent, because of unfortunate “bloodshed” hidden and forgotten incidents. From the Delphi Oracle, the divine truth will emerge spilling blood from Thebas King’s eyes, demanding vengeance, without mercy for its players. The truth as aletheia is not only power, justice and punishment through the logos -this being what is relevant- but cry, blood and death, and tragedy. (shrink)
